Foreign End Market (FEM) Verification

Tyre Stewardship Australia (TSA) recognises that to contribute to a more responsible and safer end-of-life tyre industry, all stakeholders need transparency over their supply chains in Australia and overseas.  

In Australia, TSA accredited collectors and recyclers of end-of-life tyres are monitored through the national Tyre Product Stewardship Scheme. However, when it comes to Australian tyre-derived material (TDM), tyre seconds and casings exported overseas, we lose sight of how the material is being managed. That’s where the Foreign End Market (FEM) Verification program, developed by TSA in partnership with Intertek, comes in.

TSA's FEM Verification program is helping to deliver supply chain transparency and improvement opportunities in areas such as Modern Slavery, Health & Safety, Environment and Distribution. 

How does it work?

FEM Verification Program

TSA's Foreign End Market Verification program employs Intertek’s global expertise and uses their customised supply chain risk and sustainability platform "Inlight" to independently check whether overseas customers (of Australian exported tyre seconds, casings, or tyre-derived material) meet local regulatory requirements and basic minimum standards.

The assessment criteria and guidelines are maintained by Intertek and were developed on the foundation of local national laws, International Labor Organization (ILO) conventions, and from best practice organisations in the industry. 

There are four focus areas, each with key requirements:

Modern Slavery (Social compliance)

  • No forced labour. 
  • No underage workers. 
  • Correct wages and working hours, including over-time. 

Health and Safety

  • Emergency procedures and training implemented.
  • Evacuation plans in place.
  • Fire prevention and Fire-Fighting equipment implemented, where required.
  • Safe working conditions around hazardous equipment. 

Environment

  • Relevant licence / permit to operate in place and complied with.
  • Emissions to air/land/water and waste streams are managed (e.g. suitable controls in place). 

Distribution

  • Product that is delivered to site is processed onsite.
  • Product is not simply distributed to other businesses (e.g. no hub-and-spoke models). 

The program recognises facilities that achieve a low-risk rating in the assessment by providing a 2-year expiry date for their verification, as opposed to 1 year for other facilities.  

Facilities are required to commence renewal before their verification expires and have 6 months to complete the process. 

FEM Verification gives Australian exporters reasonable assurance that they are working with responsible operators that are seeking to reduce the risk of serious social or environmental harm in their business.  

In addition, it may help Australian exporters with:  

  • Meeting their regulatory obligations. 

  • Developing their ESG policy and processes. 

  • Managing corporate reputation risks. 

  • Building stakeholder trust and confidence. 

The FEM Verification program is recognised by the Australian Department of Climate Change, Energy, the Environment and Water (DCCEEW) as supporting evidence that exporters can use in their application for a licence to export tyres (to help demonstrate that an offshore retreading facility is "appropriate", as required by the waste tyre export rules).  

FEM Verification does not, however, address 100% of DCCEEW’s criteria for what is “appropriate” (in particular, it does not look at quality assurance processes for retreaded tyres) and will not be sufficient evidence on its own.

Who can use it?

Who is the FEM Verification Program valuable for?

  • Australian businesses exporting tyres for retreading or tyre-derived materials to overseas processing facilities who want increased transparency over their downstream supply chains.
  • Businesses needing to obtain an export licence for their overseas retreading partners as part of the Federal Government's export licensing requirements.
  • Overseas processing facilities who want to demonstrate that their business receiving tyres or tyre-derived material is managing the risks of social, health & safety and environmental harm in their operations, and contributing to a responsible supply chain. 

What's involved?

The process includes five stages:

Registration

Registration with TSA and Intertek to begin the process to become a TSA FEM Verified site.

Education

Education on the FEM Verification program through a short presentation and a quiz to check your understanding. 

Self-Assessment Questionnaire

  • Self-Assessment Questionnaire (SAQ) is a desktop audit whereby a facility responds to questions about their operation in each focus area and uploads supporting evidence into Intertek’s secure Inlight platform.
  • Intertek’s local auditor will review and validate the evidence submitted in the SAQ to confirm the site complies. If the site’s validated SAQ meets TSA’s criteria, it can progress to the next step. If not, the site will receive feedback on what is needed to progress. 

Site Inspection

Physical inspection of the facility by a local auditor including conversations with management and workers, to confirm that the site has effectively implemented the systems and controls identified during the desktop audit in the field. 

Verification

  • Verification by TSA based on the validated SAQ and Site Inspection results to determine whether the site meets TSA’s pre-determined verification criteria.
  • Sites that do not meet the verification criteria will receive specific feedback on what is needed to progress.
  • Sites that do meet the verification criteria will be notified and advised of the expiry date of their Verified status – either 1 or 2 years, depending on their overall score.
  • Sites will be asked to renew their verification when the expiry date is approaching by going back through the assessment process.

Cost

What does FEM Verification cost?

TSA continues to pay for Australian businesses to have their overseas customers participate in the FEM Verification program.  

TSA has expanded the reach of the program to enable overseas organisations to nominate their customers for verification. TSA will be moving these overseas requestors for verification to a user-pays model in 2025 (either the requestor of the site to be verified, or the site themselves, will be asked to pay for the relevant assessment activities).  

As Australia's Tyre Product Steward, TSA's primary objective is to seek environmentally sound outcomes for end-of-life tyres in Australia, and to support the Australia's tyre recycling industry. TSA recognises that the FEMV program may be helpful for others in the global tyre industry, but it is not reasonable for TSA to bear the cost of their participation.

The costs involved in participating in the FEMV program are outlined in the User Manual (available on request). TSA will provide advance notice to affected program users when it is ready to switch across to the user-pays model and will seek informed consent from participants before any fees are levied.
